Terms and Conditions

Please read these Terms and Conditions carefully before using PedagogAI. By subscribing to or using PedagogAI, you agree to be bound by these terms.
1. About PedagogAI
PedagogAI ("the Service", "we", "us") is an AI-powered teaching assistant web application available at pedagogai.ca. The Service is operated by Brigette Mackay, a BC-based educator and software developer. PedagogAI is designed to assist K-7 classroom teachers with report card comments, rubric generation, math unit planning, parent communication, and other teaching tasks.
2. License and Access
Upon purchase of a PedagogAI subscription, you are granted a personal, non-transferable, non-exclusive license to access and use the Service for your own professional teaching purposes.
- Each license key is valid for use on up to 2 devices per subscriber
- License keys may not be shared, resold, or transferred to another person
- Annual subscriptions expire on July 31 each year and must be renewed to continue access
- We reserve the right to revoke a license key if we detect misuse or sharing
3. Subscription and Payment
PedagogAI subscriptions are priced at $69 CAD per year. Payment is processed securely through Lemon Squeezy. By subscribing you authorize the collection of the subscription fee.
- All prices are in Canadian dollars (CAD) unless otherwise stated
- Subscriptions are annual and renew on July 31 each year
- You will receive a renewal reminder 14 days before expiry
- Refunds are available within 7 days of purchase if you are not satisfied — contact hello@pedagogai.ca
- We reserve the right to change pricing with 30 days notice to existing subscribers
4. AI-Generated Content
PedagogAI uses artificial intelligence to generate report card comments, rubrics, unit plans, parent emails, and other content. You acknowledge that:
- AI-generated content is provided as a starting point and should be reviewed, edited, and verified by you before use
- You are responsible for all content you submit to parents, administrators, or other parties — regardless of whether it was AI-generated
- PedagogAI does not guarantee the accuracy, completeness, or appropriateness of AI-generated content for any specific student, situation, or jurisdiction
- AI-generated report card comments should always be reviewed for accuracy against your own knowledge of each student
- PedagogAI's AI features are powered by Anthropic's Claude API. Use of these features is subject to Anthropic's usage policies
5. Privacy and Student Data
We take student privacy extremely seriously. PedagogAI is designed with FIPPA (Freedom of Information and Protection of Privacy Act) compliance in mind:
- All student data (names, grades, designations, observations, IEP notes) is stored locally in your browser only — it is never transmitted to or stored on PedagogAI servers
- No student names or personally identifiable information is ever sent to AI models
- AI calls contain only anonymized data such as grade level, proficiency levels, and observation content
- You are responsible for complying with your school district's privacy policies when using any digital tool with student information
- We collect minimal data necessary to operate the service — specifically license key usage counts for billing purposes

6. Acceptable Use
You agree to use PedagogAI only for lawful professional teaching purposes. You must not:
- Share your license key with others or attempt to circumvent license restrictions
- Use the Service to generate content that is discriminatory, harmful, or inappropriate for educational settings
- Attempt to reverse-engineer, copy, or reproduce the Service or its underlying prompts and algorithms
- Use automated scripts or bots to make excessive AI requests
- Use the Service in any way that violates applicable laws or regulations
7. Intellectual Property
PedagogAI, including its design, code, AI prompt templates, and content, is the intellectual property of Brigette Mackay / PedagogAI. All rights reserved.
- The AI-generated content you create using the Service (comments, rubrics, unit plans) belongs to you
- The underlying software, prompts, and algorithms remain the property of PedagogAI
- You may not copy, reproduce, or distribute the PedagogAI application or its components
8. Service Availability
We aim to keep PedagogAI available at all times but cannot guarantee uninterrupted service. We may occasionally perform maintenance, updates, or experience downtime. We are not liable for any losses resulting from service interruptions.
AI features depend on third-party API services (Anthropic). If these services experience outages, AI features may be temporarily unavailable. Non-AI features will continue to work.
9. Limitation of Liability
PedagogAI is provided "as is" without warranty of any kind. To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service
- Our total liability to you shall not exceed the amount you paid for your current annual subscription
- We are not responsible for any decisions made based on AI-generated content
10. Changes to These Terms
We may update these Terms from time to time. We will notify existing subscribers by email at least 14 days before material changes take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of British Columbia, Canada. Any disputes shall be resolved in the courts of British Columbia.
